General Information on the Legal Basis for Data Processing on this Website
If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR and, if special categories of data pursuant to Art. 9(1) GDPR are processed, on the basis of Art. 9(2)(a) GDPR. In the event of explicit consent to the transfer of personal data to third countries, data processing also takes place on the basis of Art. 49(1)(a) GDPR (wording in the original text: “Art. 4 / 13 49 Abs. 1 lit. a DSGVO”). If you have consented to the storage of cookies or to access to information on your end device (e.g. via device fingerprinting), processing is additionally based on § 25 TTDSG (formerly TMG). Consent can be revoked at any time.
If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if this is necessary to fulfill a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interests pursuant to Art. 6(1)(f) GDPR. The legal basis applicable in each individual case is explained in the following sections of this Privacy Policy.
Access Data
The website operator or page provider collects data about accesses to the site and stores these as “server log files.” The following data are logged:
- Visited website
- Time at the moment of access
- Amount of data sent in bytes
- Source/referrer from which you reached the page
- Used browser
- Used operating system
- Used IP address
The collected data are used solely for statistical evaluations and to improve the website. However, the website operator reserves the right to subsequently review the server log files if specific indications point to unlawful use.
Personal data of the data subject are deleted or blocked as soon as the purpose of storage ceases to apply. Storage may take place beyond this if provided for by the European or national legislator in EU regulations, laws, or other provisions to which the controller is subject. Data are also blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless further storage of the data is necessary for the conclusion or fulfillment of a contract.
Your Rights
You have the right to obtain information about your stored personal data, their origin and recipients, and the purpose of data processing (Art. 15 GDPR). You also have the right to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR), and to object to processing (Art. 21 GDPR). You also have the right to lodge a complaint with a data protection supervisory authority.
Cookies
We use cookies to make our offering user-friendly. Some cookies remain stored on your end device until you delete them. They allow us to recognize your browser the next time you visit.
If you do not wish this, you can set your browser so that it informs you about the setting of cookies and you only allow this in individual cases.
When cookies are deactivated, the functionality of our website may be limited.
Handling of Personal Data
The website operator collects, uses, and discloses your personal data only if this is permitted by law or if you consent to the data collection.
Personal data are all information that serve to determine your person and can be traced back to you—such as your name, e-mail address, and telephone number.
User Account
In order to place orders via this offering, each customer must set up a password-protected customer account. This includes an overview of completed orders and active order processes. If you leave the online shop as a customer, you are automatically logged out.
The operator assumes no liability for password misuse, unless such misuse was caused by the operator itself.
Order Process
All data entered by customers in the course of order processing are stored. These include:
- First and last name
- Address
- Payment data
- E-mail address
Data will not be transmitted to third parties, with the exception of the transmission of credit card data to the processing banking institutions/payment service providers for the purpose of debiting the purchase price, to the transport/shipping company commissioned by us for the delivery of the goods, and to our tax advisor to fulfill our tax obligations.
If the purchase process is aborted, the data stored with us will be deleted. In the event of a contract conclusion, all data from the contractual relationship are stored until the expiry of the tax retention period (7 years).
As a user, you can terminate registration at any time by informal notification by e-mail to us. You can have the data stored about you changed at any time by informal notification by e-mail to us.
If the data are required for the fulfillment of a contract or for the implementation of pre-contractual measures, early deletion of the data is only possible as far as no contractual or legal obligations oppose deletion.
Handling of Contact Data
If you contact the website operator via the contact options offered, your details will be stored so that they can be used to process and respond to your inquiry. Without your consent, these data will not be passed on to third parties.
The legal basis for the processing of the data is Art. 6(1)(a) GDPR if the user has given consent.
The legal basis for the processing of data transmitted in the course of sending an e-mail is Art. 6(1)(f) GDPR. If the e-mail contact aims at concluding a contract, the additional legal basis for processing is Art. 6(1)(b) GDPR.
Withdrawal of consent may be declared informally to the e-mail address stated above. All personal data stored in the course of making contact will be deleted in this case.
SSL / TLS Encryption
For security reasons and to protect the transmission of confidential content, such as orders or inquiries you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Hosting
We host the content of our website with the following provider: All-Inkl. The provider is ALL-INKL.COM – Neue Medien Münnich, Owner: René Münnich, Hauptstraße 68, 02742 Friedersdorf (hereinafter “All-Inkl”). Details can be found in All-Inkl’s privacy policy: https://all-inkl.com/datenschutzinformationen/.
The use of All-Inkl is based on Art. 6(1)(f) GDPR. We have a legitimate interest in a presentation of our website that is as reliable as possible. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent covers the storage of cookies or access to information on the user’s end device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.
Data Processing Agreement
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law that ensures All-Inkl processes the personal data of our website visitors only according to our instructions and in compliance with the GDPR.
Newsletter
Our website offers the possibility to subscribe to a free newsletter. When registering for the newsletter, the data from the input mask are transmitted to us. Registration takes place using the so-called double opt-in procedure.
The following data are also collected during registration:
- IP address of the accessing computer
- Date and time of registration
If you purchase goods or services on our website and provide your e-mail address in the process, we may subsequently use it to send you a newsletter. In such a case, only direct advertising for our own similar goods is sent via the newsletter.
No data are passed on to third parties in connection with data processing for sending newsletters. The data are used exclusively for sending the newsletter. The legal basis for processing data after registration for the newsletter by the user is Art. 6(1)(a) GDPR, provided the user’s consent has been obtained.
The collection of other personal data during the registration process serves to prevent misuse of the services or the e-mail address used. The data are deleted as soon as they are no longer necessary to achieve the purpose of their collection. The user’s e-mail address is therefore stored as long as the newsletter subscription is active.
The newsletter subscription can be terminated by the user at any time. For this purpose, a corresponding link is provided in every newsletter. This also enables the withdrawal of consent to store the personal data collected during the registration process.
We send our newsletter using the newsletter service Brevo. Details can be found in ActiveCampaign’s privacy policy: https://www.brevo.com/features/data-security/.
Data Collection on this Website
Our websites use so-called “cookies.” Cookies are small data packets that do not cause any damage on your end device. They are either stored temporarily for the duration of a session (session cookies) or permanently (persistent cookies) on your end device. Session cookies are automatically deleted after your visit. Persistent cookies remain stored on your end device until you delete them yourself or until they are automatically deleted by your web browser.
Cookies can be set by us (first-party cookies) or by third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites (e.g. cookies for processing payment services).
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies can be used to evaluate user behaviour or for advertising purposes.
Cookies that are necessary to carry out the electronic communication process, to provide certain functions requested by you (e.g. for the shopping cart function), or to optimize the website (e.g. cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent can be revoked at any time.
You can set your browser to inform you about the setting of cookies and to allow cookies only in individual cases, to exclude the acceptance of cookies for certain cases or generally, and to activate the automatic deletion of cookies when closing the browser. When cookies are deactivated, the functionality of this website may be limited.
Which cookies and services are used on this website can be found in this privacy policy.
Third-Party Cookies
Google Analytics
This website uses the service “Google Analytics,” which is offered by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA), to analyze website usage by users. The service uses “cookies”—text files that are stored on your end device. The information collected by the cookies is usually transmitted to a Google server in the USA and stored there.
IP anonymization is active on this website. The IP address of users is truncated within the member states of the EU and the European Economic Area. Due to this truncation, the personal reference of your IP address is eliminated. As part of the agreement on order data processing, which the website operators have concluded with Google Inc., Google creates an evaluation of website usage and website activity with the help of the collected information and provides services related to Internet usage.
You have the option to prevent the storage of cookies on your device by making the appropriate settings in your browser. There is no guarantee that you will be able to access all functions of this website without restrictions if your browser does not allow cookies.
Furthermore, you can prevent the information collected by cookies (including your IP address) from being sent to Google Inc. and used by Google Inc. by using a browser plugin. The following link leads you to the corresponding plugin: https://tools.google.com/dlpage/gaoptout?hl=de
Alternatively, you can prevent Google Analytics from collecting data about you within this website by clicking an opt-out link (setting an “opt-out cookie” is required; if you delete your cookies regularly, the opt-out must be repeated).
Requests by E-mail or Telephone
If you contact us by e-mail, telephone, or fax, your inquiry including all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of handling your request. We do not pass on these data without your consent.
The processing of these data is based on Art. 6(1)(b) GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be revoked at any time.
The data you send to us via contact requests will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your inquiry has been fully processed). Mandatory statutory provisions—especially statutory retention periods—remain unaffected.
