General terms and conditions for the use of the online store

These general terms and conditions (GTC) apply to all deliveries of goods made by LOGICANA OG (hereinafter referred to as LOGICANA) based on orders placed in the web store. By placing an order, the customer agrees to these terms and conditions and is bound by them. The GTC are valid from 01.07.2026. § 1 Scope of application

(1) The following General Terms and Conditions (GTC) apply in the version valid on the day of the order for all sales contracts between LOGICANA and its customers.

(2) Should individual provisions of these GTC be ineffective in whole or in part due to mandatory legal regulations, in particular consumer protection regulations, the remaining provisions of these GTC remain effective unchanged.

§ 2 Conclusion of the contract

The offers of the LOGICANA online store are non-binding. By sending the order form, the customer bindingly declares that they wish to purchase the contents of the shopping cart. The contract is concluded through a declaration by LOGICANA, in particular by order confirmation. The declaration is sent to the customer immediately after receipt of the order form. Thereby the contract is concluded.

§ 3 Retention of title

Until full payment of the purchase price, the delivered goods remain the property of LOGICANA.

§ 4 Prices, shipping costs, price fixing

4.1 For orders in our online store, the prices listed in the offer at the time of the order shall apply. Unless otherwise stated, all prices are gross prices including the statutory value added tax, excluding all expenses incurred with shipping.
4.2 For an order value of 50 € including VAT, we deliver free of charge within Austria to the shipping address specified by the customer. Below 50 € including VAT, we charge a flat shipping fee of 4.90 € within Austria.
4.3 For deliveries within the EU, we deliver free of charge from an order value of 100 € including VAT. Below 100 € including VAT, we charge a flat shipping fee of 14.95 €.
4.4 For delivery to Germany, we deliver free of charge from an order value of 100 € including VAT. Below 100 € including VAT, the shipping fee is between 5.90 € and 7.90 €.
4.5 For delivery to Italy, we deliver free of charge from an order value of 100 € including VAT. Below 100 € including VAT, we charge a flat shipping fee of 8.90 €.
4.6 For delivery to Switzerland, we deliver free of charge from an order value of 150 €. Below 150 €, we charge a flat shipping fee of 19.95 €.

§ 5 Payment options

We offer our customers in the EU the following payment options:

- Prepayment with 2% discount on the invoice amount
- Open invoice after the 2nd order with a payment term of 14 days

§ 6 Terms of delivery

Delivery is normally made within 2 working days from the date of the customer's order, but in any case within 4 working days from the date of the order, provided the goods are available. In case of unavailability of the goods, the customer will be informed immediately. We make every effort to deliver ordered goods without delay. We keep the majority of goods that can be shipped by parcel permanently in stock.

§ 7 Right of withdrawal

7.1 Cancellation policy

Consumers have the right to cancel this contract within fourteen days without giving any reason. To exercise your right of withdrawal, you must inform us (LOGICANA OG, office@logicana.at, Friedensbach 565, A - 5721 Piesendorf, Austria) of your decision to withdraw from this contract by means of a clear declaration, for example a letter or e-mail sent by post.

In addition, an electronic withdrawal function is available on our website. You can access it via the button “Declare withdrawal” or “Withdraw from contract” visible in the footer of our online shop, as well as via the following page: https://shop.logicana.at/en/information/revocation/. You can use this function to declare your withdrawal electronically. After submitting the withdrawal, you will receive confirmation of receipt of your withdrawal declaration.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the cancellation period or use the electronic withdrawal function before the expiry of the cancellation period.

7.2 Consequences of the withdrawal

If you cancel this contract, we shall reimburse you all payments we have received from you, including delivery costs, with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the favorable standard delivery offered by us, without undue delay and no later than within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you.

In no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs for the return of the goods.

7.3 Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.

§ 8 Storage of order data

We store the contract text and send you the order data by e-mail. You can view past orders in your customer account. If you have placed your order as a guest, your order data is no longer accessible via the Internet for security reasons.

§ 9 Warranty

9.1 The warranty is in accordance with the statutory provisions. If an exchange or an improvement is not possible, too costly, unreasonable or delayed, the buyer has the right to a price reduction or, if the defect is not minor, cancellation of the contract. Compensation for consequential damages caused by defects, as well as other property damage, financial loss and damage to third parties against the customer, unless it is a consumer transaction, is excluded. Liability for normal wear and tear is excluded.

9.2 LOGICANA does not assume any warranty for defects and damages resulting from unsuitable or improper use, non-observance of application instructions or faulty or negligent handling.

9.3 Obvious defects are to be reported in writing as soon as possible after receipt of the delivery.

9.4 No new warranty or guarantee periods shall come into force as a result of a replacement under the warranty or guarantee.

§ 10 Place of jurisdiction and applicable law

10.1 This contract shall be governed by Austrian substantive law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the contractual partner is a consumer, the mandatory provisions of the law of the state in which the consumer has their habitual residence shall also apply to this contract. Place of performance of the contract is the registered office of the LOGICANA online store.

10.2 For disputes, the court with subject matter jurisdiction at the registered office of LOGICANA OG is exclusively responsible, unless mandatory consumer protection provisions provide otherwise.
