General terms and conditions for the use of the online store

These general terms and conditions (GTC) apply to all deliveries of goods made by Logicana e.U. (hereinafter referred to as Logicana) based on orders placed in the web store. By placing an order the customer agrees to these terms and conditions and is bound by them. The GTC are valid from 01.06.2022. Logicana e.U., Friedensbach 565, 5721 Piesendorf, Austria

§ 1 Scope of application

(1) The following "General Terms and Conditions" (GTC) apply in the version valid on the day of the order for all sales contracts between Logicana and its customers.

(2) Should individual provisions of these GTC be ineffective in whole or in part due to mandatory legal regulations (in particular the provisions of the KSchG), the remaining provisions of these GTC remain effective unchanged. 

§ 2 Conclusion of the contract

The offers of the Logicana online store are non-binding. By sending the order form, the consumer bindingly declares to want to purchase the contents of the shopping cart. The contract is concluded through a declaration (order confirmation) by Logicana. The declaration is sent to you immediately after receipt of the order form. Thereby the contract is concluded.

§ 3 Retention of title

Until full payment of the purchase price, the delivered goods remain the property of Logicana.

§ 4 Prices, shipping costs, price fixing 

4.1 For orders in our Internet store, the prices listed in the offer at the time of the order shall apply. Unless otherwise stated, all prices are gross prices including the statutory value added tax excluding all expenses incurred with the shipment.
4.2 For an order value of 50€ (including VAT) we deliver free of charge within Austria to the shipping address specified by the customer. Below 50€ (including VAT) we charge a flat rate of 4,9€ (including VAT) for postage and packaging in Austria. 
4.3 For an order value of 100€ (including VAT) we deliver within the EU and Switzerland free of shipping costs to the shipping address specified by the customer. Below 100€ (including VAT) we charge a flat rate of 13,95€ (including VAT) for postage and packing.
4.4 For delivery to Germany, we charge a maximum of 8.9€ gross per order under 100€ order value.

§ 5 We offer our customers in the EU the following payment options: 

- Immediate bank transfer
- paypal
- credit cards
- Prepayment (2% discount on the invoice amount)
- Open invoice after the 2nd order (14 days payment term)

§ 6 Terms of delivery 

Delivery is normally made within 2 working days from the date of the customer's order, but in any case within 4 days from the date of the order. In case of unavailability of the goods, the customer will be informed immediately. We make every effort to deliver ordered goods without delay. We keep the majority of goods that can be shipped by parcel permanently in stock.

§ 7 Right of withdrawal

7.1 Cancellation policy

You have the right to cancel this contract within fourteen days without giving any reason. To exercise your right of withdrawal, you must inform us (logicana.at, office@logicana.at, Friedensbach 565, A - 5721 Piesendorf, Austria) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter or e-mail sent by post). 

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the cancellation period.

7.2 Consequences of the withdrawal 

If you cancel this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you.

In no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs for the return of the goods.

7.3 Exclusion of the right of withdrawal

According to § 312g paragraph 2 No. 3 BGB, the right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.

§ 8 Storage of order data 

We store the contract text and send you the order data by e-mail. You can view past orders in your customer account. If you have placed your order as a guest, your order data is no longer accessible via the Internet for security reasons. 

§ 9 Warranty

9.1 The warranty is in accordance with the statutory provisions for a period of 24 months from receipt of the goods. If an exchange or an improvement is not possible (not possible, too high expenditure, unreasonable, delay), the buyer has the right to a price reduction or, if the defect is not minor, cancellation of the contract (redhibitory action). Compensation for (defect) consequential damages, as well as other property damage, financial loss and damage to third parties against the customer, unless it is a consumer transaction, is excluded. Liability for normal wear and tear is excluded.

9.2 Logicana does not assume any warranty for defects and damages resulting from unsuitable or improper use, non-observance of application instructions or faulty or negligent handling.

9.3 Obvious defects are to be reported in writing immediately, at the latest, however, within two weeks after receipt of the delivery, whereby timely dispatch suffices to meet the deadline. Otherwise, all claims for defects shall be excluded. 

9.4 No new warranty/guarantee periods shall come into force as a result of a replacement under the warranty/guarantee.

§ 10 Place of jurisdiction and applicable law

10.1 This contract shall be governed by Austrian substantive law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the contractual partner is a consumer, the mandatory provisions of the law of the state in which he has his habitual residence shall also apply to this contract. Place of performance of the contract is the registered office of the Logicana Shop.

10.2 For disputes, the court with subject matter jurisdiction at the registered office of the Logicana Shop is exclusively responsible.
